General licence for certain movements of susceptible animals between premises within the Restricted Zone

I being a veterinary inspector appointed by the Secretary of State for the purposes of the Animal Health Act 1981, grant the following licence under Schedule 7, paragraph 1 of the Order:

Licence

1. Subject to paragraphs 2, 3 and 4 and the conditions in the Schedule this licence permits the movement of susceptible animals between premises within the Restricted Zone (other than the Protection Zone or the Surveillance Zone).

2. This licence does not authorise the movement of susceptible animals if the premises of origin is in:

• the counties of Buckinghamshire, East Sussex, Essex, Hampshire, Hertfordshire, Kent, Surrey, Oxfordshire, West Sussex,
• the Cities of Southampton, and Portsmouth, and
• the Unitary Authorities of Bracknell Forest, Brighton and Hove, Medway, Reading, Slough, Southend on Sea, Thurrock, Windsor and Maidenhead, West Berkshire, Wokingham, the City of London and  London Boroughs.

3. This licence does not authorise the movement of any susceptible animal from premises onto which a susceptible animal has been moved in the 20 days preceding the date of the intended move.
 
4. This licence does not authorise the movement of a pig unless the premises of origin and premises of destination are both approved under Article 14 of the Pigs (Records, Identification and Movement) Order 2007.

5. This licence does not permit any movement of ruminant animals prohibited by a declaration of a temporary control area made in relation to Bluetongue under Article 5 of the Movement of Animals (Restrictions) (England) Order 2002.

Schedule

General Conditions relating to movements of all susceptible animals

i) The move must be direct with no multiple pick ups or drop offs during the journey.

ii)  Before leaving the premises of origin and the premises of destination, the vehicle’s wheels, wheel arches and mudflaps must be cleansed and disinfected. The cleansing and disinfection must take place at a point beyond which no contamination with animal faeces, litter or any similar matter from the premises of origin or destination can take place.

iii) Where a vehicle is used to move the animals it must be cleansed and disinfected in accordance with Schedule 2 of the Transport of Animals (Cleansing and Disinfection) (England) (No 3) Order 2003, before the first animal of a batch of animals to be moved is loaded and again after the last animal of that batch is unloaded.

iv) Anything to be disinfected under this licence shall be disinfected after cleansing has been completed, using a disinfectant approved under the Diseases of Animals (Approved Disinfectants) (England) Order 2007, at the concentration required under the Order.

v) The movement must be recorded in the holding register required under the Cattle Identification Regulations 2007, the Pigs (Records, Identification and Movement) Order 2007 and the Sheep and Goats (Records, Identification and Movement) (England) Order 2005 for the premises of origin as soon as possible after dispatch and in the holding register for the premises of destination as soon as practicable after the completion of the movement.  In any event, both holding registers must be updated to record the movement within 12 hours of the movement being completed.

vi) Any person who moves animals under this licence must take reasonable precautions to avoid the transfer of contamination between premises, in particular by wearing appropriate clothing and footwear and observing good hygiene practice.

vii) Any person who moves anything under the authority of a general licence granted under the Order must carry with him at all times during the licensed movement, a consignment note which contains details of the susceptible animals being moved, the date of the movement; the name of the consignor; the address of the premises from which the movement started; the name of the consignee; and the address of the premises of destination. On demand made by an inspector, or other officer of the Secretary of State, the person moving anything under the authority of a general licence must produce the consignment note and allow a copy or extract to be taken; and on such demand provide his name and address.

viii) The owner or keeper of the susceptible animals to be moved must sign the declaration annexed to this licence before the movement starts.  Where the owner or keeper is not the person transporting the animals, the person transporting the animals must also sign the declaration. 

ix) The owner or keeper of the susceptible animals to be moved must keep a copy of the movement licence, the declaration and, in the case of pigs, the veterinary certificate required by condition (xi) with him during the licensed movement.  Copies of the licence, declaration and, in the case of pigs, the veterinary certificate must be kept on the premises of origin for 6 months.

Additional conditions relating to susceptible animals other than pigs

x) Vehicles carrying susceptible animals other than pigs may make scheduled stops within the Restriction Zone subject to the following conditions:-

(a) The scheduled stop must be at one of the following:-

(i) a motorway service station;
(ii) a proper lay-by on a trunk / main road);
(iii) a proper lorry park or similar place.

(b) The vehicle must be parked on a hard standing.

(c) The vehicle must be parked at least 100 metres away from any livestock (those on a livestock vehicle using the same facility as well as any on adjacent land).

(d) The vehicle must carry a portable cleansing and disinfection kit (i.e. a bucket, water, approved disinfectant and a brush) or if none is carried, the place in which the vehicle is stopped must have cleansing and disinfection facilities.

(e) Any bedding, litter, dung, urine or other material that is likely to spread disease that leaks from the vehicle must be cleaned up and the area disinfected before the vehicle leaves the area; any solid waste material must be bagged and put in a separate compartment on the vehicle to which animals do not have access and taken to the point of destination for disposal.

(f) No transfers of livestock between vehicles (or unloading of livestock except in an emergency) will be allowed at scheduled stopping places.

(g) A record of the place(s) where and time(s) when scheduled stops are made must be kept by the driver and retained for six months from the date of the movement.


Additional conditions relating to the movement of pigs

xi) Any person who moves a pig under this licence must obtain within 12 hours of the intended move commencing a veterinary certificate signed by a MRCVS confirming that:

(a) he has satisfied himself that there is no clinical evidence of foot-and-mouth disease or any other notifiable disease of pigs in the pigs to be moved or in the other production units on the premises of origin at the time of the inspection;
  (b) that there is an acute or anticipated welfare problem associated with the pigs to be moved that cannot be resolved without moving them;
 
xii) Any person who moves a pig under this licence must be satisfied that a copy of the veterinary certificate required under condition (xi) above has been obtained and that a copy of it has been sent to the Meat and Livestock Commission (see notes).

xiii) The loading of pigs onto any vehicle used to transport the pigs must commence no later than twelve hours after the veterinary certificate required in condition (x) above has been signed. 

xiv) Vehicles used to carry pigs under this licence may not make any scheduled stops.


xv) Any person moving pigs under this licence must retain the veterinary certificate required at condition (x) above for a period of 2 months and produce it to an inspector on demand.

 

Notes


• This licence does not allow the movement of susceptible animals from those parts of the counties of Surrey, Hampshire, East Sussex, West Sussex, Kent, Oxfordshire, West Berkshire and Buckinghamshire and the Unitary Authorities of Reading, Wokingham, Windsor and Maidenhead, Bracknell Forrest, Slough, Brighton and Hove, the Medway and the administrative area of the Greater London Authority which are in the Restricted Zone.  However, it does not prevent a movement through or into those areas.

• This licence does not prevent a movement through or into those parts of the following areas which are in the restricted zone:

o the counties of Buckinghamshire, East Sussex, Essex, Hampshire, Hertfordshire, Kent, Surrey, Oxfordshire, West Sussex,
o the Cities of Southampton, and Portsmouth, and
o the Unitary Authorities of Bracknell Forest, Brighton and Hove, Medway, Reading, Slough, Southend on Sea, Thurrock, Windsor and Maidenhead, West Berkshire, Wokingham, the City of London and  London Boroughs.

• This licence does not prevent a movement through the Protection Zone or a Surveillance Zone but the movement through such zones must be without stopping.

• All movements are subject to the animals being properly identified and accompanied by the appropriate duly completed AML form and the movements must be reported to the local authority.

• All movements must be in full compliance with the Cattle Identification Regulations 2007, the Pigs (Records, Identification and Movement) Order 2007 and the Sheep and Goats (Records, Identification and Movement) (England) Order 2005.

• Movements of bovines must be reported within 3 days to the British Cattle Movement Service (BCMS) either by using CTS-online or by completing and posting one of the movement cards in the passport.

• Where required, bovine tuberculosis pre-movement testing must be completed.

• Moves under this licence must meet the requirement for maximum journey times, fitness to travel and all other rules on the welfare required under Council Regulation (EC) No 1/2005 of 22 December 2004 on the protection of animals during transport and any other legislation relating to the transport of animals including those relating to drivers’ hours.

• Failure to observe the measures required in this licence is an offence under Section 73 of the Animal Health Act 1981. The penalty on conviction of an offence under that section is a maximum of six months imprisonment and/or a £5,000 fine.
